How to Begin Your Dispute Resolution Process
Disputes can be challenging. Knowing how to approach these situations calmly and constructively is essential. Use our four steps to help you begin the dispute resolution process.
Step 1:
Determine the Best Process
Initial contact must come from both parties together to ensure neutrality from the outset.
Whether Mediation, Arbitration, or Med-Arb, both parties must agree on the format. Kim will help clarify which approach is most appropriate based on the nature of the dispute.
Contact KimStep 2:
Intake & Agreement
Each participant completes a brief intake form. Kim will provide a contract outlining the process and terms. A deposit will be required at this stage.
Step 3:
Pre-Session Meetings
Kim meets individually with each party (virtually or in person) to review goals, expectations, information preparedness and to ensure the chosen process meets the needs and interests of each individual party.
Step 4:
Dispute Resolution Session
The session proceeds according to the selected format:
- Mediation – A facilitated process to reach mutual agreement.
- Arbitration – A formal process where Kim renders a binding decision.
- Med-Arb – Begins as mediation, and if needed, transitions to arbitration for unresolved matters.
